Terms of Service
These Terms of Service ("Terms") govern your use of services provided by My System of Growth ("Company," "we," "us," or "our"). By purchasing or using our services, you agree to these Terms.
1. Description of Services
My System of Growth provides a done-for-you marketing and automation system built inside a GoHighLevel account, including lead capture, automated follow-up, booking, review requests, and related tools ("the Services"), configured for your business.
2. Fees and Payment
- A one-time setup fee of $997, due before work begins.
- A recurring fee of $397 per month beginning once the Services are live.
- A minimum term of three (3) months from the Services' live date, after which service continues month-to-month until cancelled.
You are responsible for all fees due during the minimum term regardless of your usage of the Services.
3. No Refund Policy
All payments, including the setup fee and monthly fees, are non-refundable, except as expressly provided under the Launch Guarantee and Build Guarantee described in Section 4 below. By purchasing, you acknowledge and agree that you are not entitled to a cash refund under any other circumstance.
4. Guarantees
Launch Guarantee. If your system is not live within ten (10) business days of us receiving all required branding, service, and account details from you, we will credit your account one (1) month of service at no charge.
Build Guarantee. If any feature or automation included in your build is not functioning as described, we will repair or correct it at no additional charge.
These guarantees are the sole and exclusive remedies available for issues with the build or launch timeline and do not include cash refunds. Delays caused by your failure to provide timely information, approvals, or access do not count toward the Launch Guarantee timeline.
5. Client Responsibilities
You agree to provide accurate branding, service, and pricing information in a timely manner, respond to requests needed to complete setup, and use the Services in compliance with applicable law, including telemarketing and messaging regulations.
6. Account Ownership
The GoHighLevel account built for you, and the data contained within it, belongs to you. Upon cancellation, we will provide reasonable assistance to transfer or export your account data, subject to any applicable platform limitations.
7. Intellectual Property
The underlying system architecture, templates, workflows, and processes used to build your account remain the intellectual property of My System of Growth. This does not restrict your ownership or use of your own account, content, or client data.
8. Communications Consent
By providing your phone number and email address, you consent to receive service-related calls, texts, and emails from us. Message and data rates may apply. See our Privacy Policy for full details, including opt-out instructions.
9. Limitation of Liability
To the fullest extent permitted by law, My System of Growth's total liability for any claim arising from the Services is limited to the amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.
10. Termination
Either party may terminate these Terms after the minimum term has been satisfied, with written notice. We may suspend or terminate Services for non-payment or violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law principles.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
